The SBA aims to make the SBA 504 loan available to more small businesses by relaxing eligibility criteria, reducing required documentation and implementing an updated credit policy.<\/p>\n<p><strong>Summary of new SBA regulations*:<\/strong><\/p>\n<p><strong>Effective May 12th, 2023<\/strong><\/p>\n<ul>\n<li>Simplification of Affiliation rules:\n<ul>\n<li><u>Affiliation via Ownership<\/u> &#8211; Affiliation is now generally defined as owners and\/or businesses with more than 50% ownership in another entity within a similar line of business, thus greatly reducing affiliation by ownership scenarios.\u00a0 There are nuances to this so we will share more details as we receive them or reach out to your TMC Business Development Office to discuss. <strong>Impact<\/strong>: less financial information will be required, more SBA dollars are available, and in some situations, fewer personal guarantees will be required.<\/li>\n<li><u>Affiliation via Management<\/u> &#8211; SBA is removing this rule <span class=\"TextRun SCXW38011642 BCX0\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun CommentStart CommentHighlightPipeRest CommentHighlightRest SCXW38011642 BCX0\">including the principle of control of one entity over <\/span><span class=\"NormalTextRun CommentHighlightRest SCXW38011642 BCX0\">otro<\/span><\/span><span class=\"TextRun SCXW38011642 BCX0\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun CommentHighlightRest SCXW38011642 BCX0\">.<\/span><span class=\"NormalTextRun CommentHighlightRest SCXW38011642 BCX0\">\u00a0<\/span><\/span><span class=\"EOP CommentHighlightPipeRest SCXW38011642 BCX0\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\"><strong>Impact<\/strong>: SBA no longer needs to review Management Agreements.\u00a0<\/span><\/li>\n<li><u>Affiliation via Identity of interest<\/u> &#8211; SBA is removing this rule with the exception of spouses and children. <strong>Impact<\/strong>: previously siblings and other extended family members could be tied in and that is no longer the case.<\/li>\n<li><u>Affiliation via Franchise and License Agreements<\/u> &#8211; SBA is removing this rule. The SBA Franchise Directory will no longer be published. <strong>Impact<\/strong>: Franchise Agreements do not need SBA review.\n<ul>\n<li style=\"text-align: left;\"><a href=\"https:\/\/www.tmcfinancing.com\/wp-content\/uploads\/2023\/07\/NADCO-Affiliation-flow-chart-6-28-23.pdf\" target=\"_blank\" rel=\"noopener\">View SBA Affiliation Flow Chart<\/a><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>SBA has streamlined and modernized lending by reducing factors for determining creditworthiness and reasonable assurance of repayment from nine to three requirements. The three lending requirements are as follows:\n<ul>\n<li>Credit score or history of the applicant, its associates, and guarantors<\/li>\n<li>Earnings or cash flow of the applicant<\/li>\n<li>Equity or collateral of the applicant, as applicable<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Effective August 1st, 2023<\/strong>\n<ul>\n<li><u>Character Clearances<\/u> &#8211; SBA will run a background check to determine if a borrower is <strong><em>actualmente<\/em><\/strong> on probation, parole, incarcerated or under indictment. Past convictions will not impact loan approvals. Fingerprint cards and incident reports will no longer be required for past convictions.<\/li>\n<li><span style=\"text-decoration: underline;\">Personal Liquidity<\/span> &#8211; Historically, SBA may decline projects when there is an abundance of personal liquidity. With the new changes, there will be more leniency in this situation.\n<ul>\n<li>(<em><a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/04\/10\/2023-07173\/affiliation-and-lending-criteria-for-the-sba-business-loan-programs\" target=\"_blank\" rel=\"noopener\">source: SBA final rule<\/a><\/em>)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><em>*All\u00a0SBA 504\u00a0information above is subject to full pending SBA implementation guidance \u2013 required regulations,\u00a0notices,\u00a0and revised forms.\u00a0 The regulations surrounding a CDC\u2019s ability to implement the new regulatory changes are still being finalized.
